Jigawa High Court Sentences 2 Men to 4 Years Imprisonment for Criminal Conspiracy and Abetment

Jigawa State High Court Sitting in Gumel Presided Justice Abubakar Mohammed Sambo has On Monday 30th August 2021 delivered judgment against one: Muhammad Sani and Rabilu Usman charged for Criminal Conspiracy and Armed robbery.

The fact of the case was that five men namely 1. Usman Aliyu Abubakar 2. Muhammad Sani 3.Rabilu Usman 4. Sani Yahayya Bajjo 5. Abdulzarak Muhammad allegedly conspired and robbed one Alhaji Saminu Hussaini of Dantanoma Quarters Area of Gumel Local Government. However, they were arraigned before the court and were granted bail. Usman Aliyu Abubakar, Sani Yahayya and Abdul Razak Mohammed jumped the bail; hence a separate trial was conducted for the two defendants

During the trial, the prosecution called four (4) witnesses and tendered extrajudicial statements of the defendants in evidence, i.e. exhibits F, F1, G and G1. On the other hand, the defendants testified in their defence.

Hon. Justice Abubakar Sambo found that the offence of Armed Robbery was not established against two defendants by the prosecution. However, the court held that the defendants were guilty of lesser offences of Criminal Conspiracy and Abetment based on the prosecution’s evidence.

The court, in sentencing 1st defendant, considered that he is seriously sick, and the 2nd defendant being a student at College of Education Gumel, sentenced the defendants to Four (4) years imprisonment for each of the two offences. The sentence shall run concurrently and include the days already spent in detention awaiting trial since 25 – 04 – 2019.
